1. Acceptance of Terms
By accessing or using the Tradezy platform (the “Platform”), you acknowledge and agree to these Terms and Conditions (“Terms”), which govern your use of the services provided by Tradezy. These Terms constitute a legally binding agreement between you and Tradezy. If you do not agree with these Terms, you must not use our Platform.
2. Description of Services
Tradezy is a third-party service facilitation platform that connects customers seeking household trade services (e.g., plumbing, HVAC, electrical) with independent, self-employed trades professionals (the “Contractors”). Tradezy does not perform any trade services directly and is not liable for the work quality, timing, conduct, or licensure of any Contractor.
3. No Employment Relationship
Tradezy is not the employer of any Contractor. All Contractors operate as independent service providers and are not agents, employees, or representatives of Tradezy. Tradezy does not supervise, direct, or control the work, tools, or methods of Contractors. Any issues arising from the provision of services are to be resolved directly between the Customer and Contractor.
4. Booking Services
Customers may use the Platform to:
- Submit a service request form
- Receive a response (confirmation or follow-up)
- Approve a quote and authorize service
All bookings are subject to Contractor availability. Submitting a request does not guarantee that a Contractor will accept the job. By submitting the service request form, you agree to the Booking Disclaimer and Customer Agreement, which outlines the scope of your responsibilities and Tradezy’s limited role.
5. Pricing and Payments
5.1 Fee Structure
Tradezy facilitates payments between Customers and Contractors. When the job is complete, the Customer will be charged a total that includes:
- Service Fee (set by the Contractor)
- Platform Fee (retained by Tradezy for facilitating the job)
All fees are shown transparently prior to payment.
5.2 Payment Process
5.21. Customer Payment Collection
- Customers pay in full once the job is complete through their preferred method of payment.
- Payments that are processed securely via Stripe will include standard third-party payment processing fees (Stripe’s 3.0% per transaction) in the final amount displayed to the Customer.
- Customers may choose to pay by e-Transfer to contact@tradezy.ca, which carries no additional processing fees.
5.22. Job Completion and Contractor Payout
- Once the job is marked as complete by the Customer (or automatically completed after 72 hours without dispute), Tradezy releases the Contractor’s payment.
- Contractor payouts are typically processed within 1–3 business days.
- Contractors are not paid directly by Customers.
- All payments are required in full within 24 hours of job completion, unless otherwise agreed in writing.
5.23. Disputes and Delays
- If a dispute is submitted, Tradezy may temporarily hold funds until the issue is reviewed.
- Tradezy is not obligated to resolve disputes but will act in good faith to mediate.
- We reserve the right to withhold payment to Contractors in cases of poor service, fraud, or breach of agreement.
5.3 Taxes and Invoicing
- Customers may request invoices, which will include service descriptions and final costs.
- Contractors are responsible for reporting all applicable taxes.
- Tradezy does not issue T4As, T5018s, or tax slips.
6. Non-Circumvention Policy
To maintain the integrity of the Tradezy platform and ensure a consistent quality of service, all users agree to book and pay for services exclusively through Tradezy. Customers may not engage, solicit, or attempt to contract directly with any tradesperson introduced or assigned through Tradezy for services outside the platform, whether during or after a Tradezy-initiated service.
Engaging in such activity:
- Violates these Terms of Use
- May result in termination of platform access
- May result in additional administrative or legal action if such actions result in damages to Tradezy’s business
7. Response Times and Availability
- Tradezy accepts service bookings and inquiries 24 hours a day, 7 days a week through its website and communication channels.
- While our platform is always available, responses to messages or booking requests submitted outside of regular working hours may experience slight delays.
Tradezy aims to reply to all inquiries as promptly as possible and prioritizes urgent service matters. However, response times may vary depending on time of day, service demand, and staff availability.
8. Cancellations and Refunds
Before Service Confirmation:
- Customers who cancel before a job has been confirmed may receive a full refund.
After Service Confirmation:
- Once a job has been confirmed and scheduled, a 15% cancellation fee may apply to cover administrative and scheduling costs.
After Job Completion:
Refunds for completed services are not guaranteed. However, Tradezy may review refund requests in exceptional cases, including:
- Fraud or misrepresentation
- Gross negligence
- Job not performed as agreed
Tradezy reserves the right to deny refund requests that are deemed abusive, unjustified, or inconsistent with this policy.
9. Customer Responsibilities
By booking through Tradezy, you agree to:
- Provide accurate service descriptions and access instructions.
- Be present or provide access during scheduled service times.
- Notify Tradezy promptly of any concerns or disputes.
- Accept the Booking Disclaimer prior to final submission of your service request.
10. Contractor Responsibilities
All Contractors on Tradezy must:
- Be independent professionals with the necessary licenses, insurance, and permits.
- Maintain high standards of professionalism, conduct, and punctuality.
- Resolve disputes in good faith and provide service guarantees where applicable.
- Accept payment terms and acknowledge that Tradezy controls all payment disbursement.
Tradezy may suspend or permanently remove Contractors for:
- Customer complaints
- Unlicensed activity
- No-shows or repeated late arrivals
- Unsafe conduct or abuse
11. Tradezy’s Role and Liability
Tradezy acts solely as a neutral facilitator, providing a platform to connect Customers and Contractors. Tradezy:
- Does not guarantee the availability, quality, or safety of services.
- Does not provide warranties for completed jobs.
- Is not liable for property damage, bodily injury, or service deficiencies.
By using our Platform, you agree to release Tradezy from all claims related to services performed, except where prohibited by law.
12. Limitation of Liability
To the maximum extent permitted by law:
- Tradezy is not liable for any indirect, incidental, or consequential damages.
- In any event, Tradezy’s total liability will not exceed the Platform Fee paid by the Customer for the disputed service.
13. Data Collection and Privacy
Tradezy collects personal information in accordance with our Privacy Policy. This includes:
- Name, email, phone number
- Job request details
- Location and access notes
We do not sell or share customer information with third parties except:
- To Contractors for job performance
- For fraud prevention and legal compliance
14. Platform Use and Restrictions
Users must not:
- Use the Platform for illegal or unauthorized purposes.
- Impersonate another person or submit false service information.
- Contact Contractors or Customers to bypass Tradezy’s payment system.
- Abuse or spam the booking form or customer contact channels.
Violating these rules may result in permanent bans or legal action.
15. Modifications to Terms
Tradezy reserves the right to modify these Terms at any time. Users will be notified of significant changes. Continued use of the Platform after changes implies acceptance of the revised Terms.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta, and applicable laws of Canada, without regard to conflict of law principles.
